" The ERIKA case is now once again before the French Courts. The ERIKA case involves one of the worst petrol spills in the history of maritime transport.

This case involves a boat owned by Italian individuals/entities and certified by RINA a Government authorized certification Italian agency. At the center of the case is the opacity surrounding the ownership of the ERIKA and the inexplicable certification of the boat by RINA.

An experts’ report, which is presented on this website, in that case was submitted to the Dunkirk Commercial Court in 2005. The report sheds an interesting light on the deficiencies of the certification procedures by RINA.

THE EXPERTS’ REPORT

RINA certified the Erika’s seaworthiness:

"International Load Line Certificate: the Erika’s certificate was dated December 16, 1998 and was valid until August 31, 2003;
Safety Construction Certificate: the Erika’s certificate was dated December 16, 1998 and was valid until August 31, 2003;
International Pollution Prevention Certificate: the Erika’s certificate was dated December 16, 1998 and was valid until August 31, 2003;
Safety Equipment Certificate: the Erika’s certificate was dated December 16, 1998 and was valid until August 14, 2000;
Radio Certificate: the Erika’s certificate was dated November 23, 1999 and was valid until March 31, 2000."

ON DECEMBER 19, 1999 THE ERIKA BROKE UP OFF THE COAST OF BRITTANY.

The experts report states "the facts described hereabove show at the time of the five-year special survey, RINA absolutely did not fulfill the duties impose on it by its own rules..."

WHY WOULD THE RINA INSPECTORS DELIVER THE PRECIOUS CERTIFICATES? "
